Fatal Truck Accidents in California

According to the Governors Highway Safety Association, in 2016, nearly 700 pedestrians died after being hit by a vehicle in California. Although pedestrian accidents are not as frequent as other types of accidents, when they do occur, they have some of the gravest outcomes. Unfortunately, California also reports more pedestrian accidents than any other state in the country, which means that California’s roads are some of the most dangerous for pedestrians. As a result, California has enacted a set of pedestrian right-of-way laws to try to reduce the number of pedestrian accidents that occur. In California, a driver must yield the right-of-way to a pedestrian in all crosswalks at intersections. Failing to follow this law will likely cause the driver to be liable for any accident in which a pedestrian is hit.

Thousands of commercial trucks travel California’s roads and highways every day. Accidents involving large trucks and pedestrians are happening more frequently. More people are walking to get to work, school, for exercise, or simply to enjoy nature. It is hard for trucks to see pedestrians, since the trucks are much higher off the ground than passenger vehicles, and have larger blind spots. However, all drivers, including commercial truck drivers, owe a duty of care to pedestrians to drive cautiously to avoid causing harm to others. This means keeping a watchful eye out for pedestrians at all times.
