Authorities interviewed the driver of the truck who remained at the scene. A full investigation into the Clovis truck accident remains ongoing.

Liability for Fresno County Truck Accidents

Motorcyclists have a naturally small profile and are more likely to be overlooked by other vehicles. According to the National Highway Traffic Safety Association, “Motorcycle riders continue to be overrepresented in fatal traffic crashes. In 2022, there were 6,218 motorcyclists killed — 15% of all traffic fatalities. NHTSA data show that this is the highest number of motorcyclists killed since at least 1975.” Commercial trucks can be dangerous to motorcyclists for a number of reasons.

  • Trucks have large blind spots that can obscure the presence of a motorcyclist.
  • Trucks have a wide turning radius, which can dramatically increase the odds of a side impact collision.
  • Trucks have a high center of gravity, which can lead to motorcyclists being pulled underneath the vehicle in the event of a crash.

Truck drivers are required to get a commercial driver’s license. They must operate with an abundance of caution in order to avoid causing accidents. According to Title 49 of the Code of Federal Regulations, truck drivers are only permitted to work a certain number of hours every day and throughout the week. They must also take periodic breaks during the day to ensure that they are well rested. If a truck driver fails to slow down in order to avoid colliding with a motorcyclist, this could form the basis of a negligence claim.

Several other parties could potentially be held at fault for any truck accident. This may include the carrier that a truck driver worked for. In general, employers are vicariously liable for the wrongful actions of their employees who are working within the scope of their job duties. However, many truck companies will hire their truck drivers as independent contractors in order to avoid responsibility for collisions. It is important that several steps are taken after any serious truck accident.

  • The employment status of the truck driver involved should be understood.
  • The truck involved in the collision should be inspected.
  • The circumstances leading up to the crash should be investigated.
  • An experienced truck accident attorney should be contacted.

Truck accidents are often highly preventable. They tend to occur when one or more safety regulations are not being followed. In particular, 10% of all truck drivers involved in a fatal collision reported feeling under pressure from their carrier. Truck drivers are more likely to make serious mistakes when they are fatigued or pressured. Any person injured due to the negligent actions of a truck driver may be able to seek some measure of accountability through a bodily injury claim.
