Liability for San Bernardino County Truck Accidents
Trucks and other large vehicles pose a serious injury hazard. Motorcyclists are uniquely vulnerable. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” Drivers should take a number of measures in order to avoid hitting motorcyclists.
- Drivers should check their blind spots before making turns.
- Drivers should use their horn when necessary to alert others of their presence.
- Drivers should slow down during periods of reduced visibility and inclement weather.
All drivers have a legal obligation to exercise due care in order to avoid collisions. A large number of collisions involve drivers making dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle attempting to turn left or make a U-turn must first yield the right-of-way to the driver of any vehicle that is close enough so as to pose a hazard. If a truck driver turns into the path of a motorcyclist, this could form the basis of a negligence claim.
The company that operated a commercial truck involved in a collision could also be held at fault for the collision. In general, employers can be held vicariously liable for the negligent actions of their employees. This could include situations where trucks are being used to transport goods. It is critically important that certain steps are taken after any truck accident.
- Eyewitnesses should be interviewed.
- Surveillance footage should be sought.
- Photos of the accident should be taken.
- The police report of the accident should be reviewed.
The physical evidence left behind after an accident can help paint a clear picture of what happened. This is true even if a truck driver or their insurance provider is denying liability for the collision. Truck accidents are often highly preventable. They tend to involve truck drivers that are failing to properly scan the road for hazards. Family members of any person killed in a truck accident may be able to seek some measure of accountability through a civil claim.
