Liability for Los Angeles County Truck Accidents
Many truck accidents are the result of unsafe lane changes. Pursuant to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.” Truck drivers may have acted negligently prior to a collision in many different ways.
- Blind Spots: A truck driver may have failed to check their blind spots before changing lanes on the freeway.
- Driver Distraction: A truck driver may have been distracted by their phones or other objects.
- Speeding: A truck driver may have been traveling too fast for the prevailing conditions.
All drivers in California must exercise caution to avoid colliding with other drivers. Truck drivers must be particularly cautious given the inherent dangers associated with driving a larger vehicle. When a truck driver violates a traffic regulation that results in an accident, this could form the basis of a negligence claim. The company that the truck driver worked for could also be held at fault for a collision.
Preventing Los Angeles Truck Accidents
Trucks account for a relatively small number of the total vehicles on the roadway, but they are involved in a high number of fatal collisions. According to the National Safety Council, “In 2023, 5,375 large trucks were involved in a fatal crash, an 8.4% decrease from 2022 but a 43% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is down 8% from 2022, but up 22% in the last 10 years.” Truck companies should take several measures to prevent truck accidents.
- Background Checks: All truck drivers should undergo background checks and have a commercial license that is in good standing.
- Inspections: All commercial trucks should be routinely inspected and well-maintained.
- Technology: Truck companies should consider equipping their trucks with technological features such as forward collision avoidance systems.
The vast majority of truck accidents are completely preventable. They tend to involve situations where traffic regulations are not being followed. It is relatively common for truck drivers to work while they are fatigued. These drivers are often asked to work at all times of the night and day. Roughly one in ten truck drivers involved in a fatal collision reported feeling under pressure from their carrier. The family of any person killed in a truck accident may be able to seek some measure of justice through a wrongful death claim.
