Liability for Kern County Motorcycle Accidents
Every driver in California must use caution to avoid colliding with motorcyclists and other vehicles in the roadway. They must be particularly careful when making left turns. Pursuant to CA Veh Code § 21801, the driver of any vehicle intending to turn left or complete a U-turn in the roadway must first yield the right-of-way to any driver traveling from the opposite direction that is close enough to pose a hazard. Many different factors could contribute to a left-turn collision.
- A driver may have failed to check their blind spots before initiating a turn on the roadway.
- A driver may have miscalculated the speed of oncoming vehicles.
- A driver may have been impaired due to their use of drugs or alcohol.
- A driver may have focused on pedestrian traffic and failed to scan for oncoming vehicles.
If a driver turns into the path of an oncoming vehicle, they will typically be held at fault in the event of a collision. It is also possible that several other parties could face liability for a car accident in addition to any responsible driver. In particular, the company that owned or operated a delivery van may be liable. Business owners can be vicariously liable for the wrongful actions of their workers who were performing their job duties or otherwise advancing the interests of their employer.
Common Injuries Associated with Motorcycle Accidents
Motorcyclists lack the protection of enclosed vehicles and are far more likely to be seriously injured or killed in the event of a car accident. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023.” Victims of motorcycle accidents tend to suffer very serious injuries.
- Broken bones
- Spinal cord injuries
- Organ damage
- Traumatic brain injuries
- Severe abrasions
- Blunt force trauma
Even if a person’s physical injuries completely heal following a motorcycle accident, they are often left with long-term psychological trauma. This is particularly common if a victim feels as though their life was in danger prior to a crash. Unfortunately, insurance companies are simply not interested in fairly compensating the victims of motorcycle accidents. This is why it is so important for accident victims to seek the guidance of an experienced motorcycle accident attorney.
