Liability for Los Angeles County Semi-Truck Accidents
Semi-trucks pose a unique danger to other drivers due to their weight and size. According to the IIHS, “The federal commercial vehicle maximum weight standard on the interstate highway system is 80,000 pounds gross vehicle weight, unless a higher maximum weight existed on the state level before July 1, 1956. Off the interstate highway system, states may set their own commercial vehicle size and weight standards.” There are many other federal regulations that truck companies must abide by.
- Driving Hours: Truck drivers are not allowed to operate more than 14 consecutive hours after they begin their route. They must also take a rest break for 30 minutes once they have operated their vehicle for a total of 8 cumulative hours.
- Logging Devices: Truck drivers are required to use electronic logging devices in order to ensure compliance with federal regulations for work hours.
- Commercial License: All commercial truck operators must have a valid commercial driver’s license. They will either need a Class A, Class B, or Class C driver’s license, depending on the weight of their truck.
- Maintenance: Commercial trucks must be routinely inspected and well-maintained. Truck drivers must also report any defects or issues that they encounter during their trips.
Truck drivers are held to a high standard in terms of safety. They must operate with an abundance of caution. But in far too many situations, truck drivers failed to slow for oncoming traffic and hit vehicles in front of them. Pursuant to California Vehicle Code 21703, the driver of a motor vehicle shall not follow another vehicle more closely than would be safe and reasonable given the prevailing conditions and traffic on the roadway. There is a presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of traffic.
Liability for a truck accident could extend to the owner-operator of a truck if the actions of a truck driver created a reasonably foreseeable risk of harm. Consider, for example, Lawson v. Safeway Inc (2010). A Safeway truck was lawfully parked off the highway, not far away from a hotel. Another motorist collided with the parked truck and was seriously injured. The California Court of Appeal held that the truck company could be liable because the location of the parked truck created a reasonably foreseeable risk of harm, despite the fact that it was parked legally. It is important that certain actions are taken after any truck accident.
- Police Report: Accident victims should contact the police so that an official police report of the incident is created.
- Medical Evaluation: It is critical that accident victims seek a thorough medical evaluation after the accident. Many of the injuries associated with a truck accident may not be outwardly obvious.
- Evidence Collection: Victims should document as much evidence as they can. This will include taking photos and videos of the accident site and any injuries they might have sustained.
- Attorney: Accident victims should consult with an experienced California freeway truck accident attorney.
Truck accidents can have a profound impact on the lives of victims. Many people will need to take extensive periods of time away from work. They may also be left with high medical bills. It is fairly common for victims to sustain injuries that harm their long-term mobility. Any person that is injured due to the negligent actions of a truck driver may be able to seek some measure of accountability through a personal injury claim. If you’ve been injured in a truck accident, a California freeway truck accident attorney can examine all of the unique facts of your case and let you know if you have a claim that can be pursued.
