Liability for Visalia Amazon Truck Accidents
Truck drivers are required to get a commercial license. They must operate with an abundance of caution to avoid accidents. Many collisions involve truck drivers who ignore traffic regulations. Pursuant to CA Veh Code § 21453, “A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.” It is important that evidence is properly preserved after any collision.
- Police Report: The police should be called to the scene as soon as possible so that they can begin an investigation into what happened.
- Photos: Victims should be proactive and take photos of the accident site if possible.
- Surveillance Footage: Any surveillance footage that may have captured the collision should be sought.
- Medical Records: The injuries that a person sustains in a car accident can help paint a clear picture of what happened.
There is a presumption of negligence on the part of any driver that goes past a yield sign or a red light without stopping. These accidents could be caused by a variety of different factors. In particular, truck drivers are often put under an enormous amount of pressure to complete their routes as quickly as possible. It is common for them to become dangerously fatigued.
Third-Party Liability for Visalia Truck Accidents
Truck accidents are often highly complex events. The factors that may contribute to a truck accident may take place hours or days prior to the actual incident. Depending on the facts of any case, there could be numerous liable parties for any truck accident. What matters is how an accident took place. Here are just a few of the parties that could face liability for a truck collision.
- Truck Driver’s Employer: The company that a truck driver worked for could be held at fault for a collision. Generally speaking, employers are liable for the wrongful actions of their employees who are operating within the course and scope of their job duties.
- Maintenance Company: Trucks have a high utilization rate and are prone to breaking down if they’re not routinely inspected and maintained. The company responsible for maintaining a truck could be liable for a collision if maintenance workers failed to correct a known issue.
- Truck Manufacturer: The company that made a truck or its component parts could be liable for a collision if it was caused by a design defect. For example, the brakes on a truck may have failed, or the accelerator may become stuck.
Victims of truck accidents tend to suffer very serious injuries. These injuries could result in lasting trauma and compromise their ability to work and perform daily activities. It is essential that victims of truck accidents consider all of their legal options. They may be entitled to receive damages through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
