Liability for San Diego County Tour Bus Accidents
Every person operating a motor vehicle in California must exercise due care to avoid collisions. California law imposes heightened safety requirements on bus operators because of their status as common carriers. Under California Civil Code § 2100, common carriers are required to use the utmost care and diligence to ensure the safe transportation of their passengers. California Vehicle Code § 21703 requires drivers to maintain a safe following distance with any vehicle ahead of them. Investigators will take into consideration numerous safety issues when examining how any bus accident occurred.
- Speed: The speed of any bus driver will be taken into consideration. Even if a bus driver was traveling at the speed limit, this may still be considered unsafe given the prevailing conditions.
- Vehicle Maintenance: Another important item to examine is whether or not fatigue or excessive working may have played a role in the collision. There are federal regulations that govern how many hours bus and truck drivers are allowed to work.
- Distraction: Most buses are covered by internal and external cameras. These can help reveal whether a bus driver may have been distracted prior to rear-ending a vehicle.
- Secondary Vehicles: It is also worth considering whether or not the conduct of another commercial vehicle or driver may have played a role in the crash.
If a tour bus operator fails to slow down to avoid a collision, this could be used as evidence of negligence. Liability for such a collision could extend beyond any bus driver determined to be at fault. The owner or operator of that bus could also be vicariously liable. Consider, for example, Kazanjian v. Pacific Greyhound Lines, 92 Cal. App. 2d 210 (California Court of Appeal 1949). In that case, a greyhound bus passenger was injured after the bus collided with a garbage truck leaving the station. Attorneys for the plaintiff argued that the driver of the greyhound bus acted negligently by failing to anticipate that a vehicle could exit from an alley he knew was used for traffic.
Preventing Tour Bus Accidents in California
Accidents involving commercial buses and trucks result in many preventable injuries and deaths each year across California in the United States. The Federal Motor Carrier Safety Administration has reported that at least 124,000 people were injured in collisions involving large trucks or buses in 2022. An estimated 213 buses were involved in fatal collisions that same year. There are a number of measures that tour bus companies should take to prevent collisions.
- Training: Tour bus companies should ensure that all of their drivers undergo rigorous training.
- Technology: Tour bus companies should consider adopting technological features like forward collision avoidance systems.
- Rest Breaks: Tour bus companies should ensure that their drivers are adequately rested and allowed periodic breaks over long shifts.
- Maintenance: Tour bus companies should ensure that their vehicles are periodically inspected and well maintained.
Rear-end collisions are among the most common types of accidents that occur. They are also the most preventable. They tend to nearly always involve drivers that were speeding or following another vehicle too closely. These collisions can involve liability on multiple different entities, given all of the operators and owners involved. Any person injured in a tour bus collision may be able to pursue some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
