Sadly, one person died as a result of the crash. Deputies closed several lanes of the freeway as they collected evidence and processed the scene.
A full investigation remains ongoing at this time.
Liability for Riverside County Truck Accidents
Truck drivers are required to obtain a commercial license and expected to operate with an abundance of caution to avoid hitting other vehicles. Many collisions involve truck drivers that make unsafe lane changes. According to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.” There are several factors that can make semi-trucks particularly dangerous.
- Weight: Semi-trucks can weigh 80,000 lbs and can be extremely dangerous even at lower speeds.
- Stopping Distance: Semi-trucks have a much longer stopping distance than passenger vehicles. Truck drivers must maintain adequate separation to avoid collisions.
- Blind Spots: Semi-trucks have large blind spots that can easily obscure the presence of other vehicles.
If a worker is injured or killed in California, they or their surviving family members will typically have recourse through the workers’ compensation system. Workers’ compensation is not based on fault or a negligence claim. An injured worker or their family may also have recourse through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to a crash. This could include another driver or truck company that is determined to be at fault.
Steps to Take After Riverside County Truck Accidents
The trucking industry has one of the highest rates of workplace fatality and serious injury. According to one study in the National Institutes of Health, “Truck drivers and driver-sales workers had an average annual fatality rate of 27.5 (95% CI = 26.8–28.2) fatalities per 100,000 workers, which represented a risk of fatal injury seven times higher than the average annual rate for all workers in the United States (3.9 per 100,000) during the study period.” There are certain steps that should be taken after any truck accident.
- Any person that may have witnessed the crash should be interviewed as early as possible.
- Surveillance footage that may have captured the crash should be sought.
- The information on the event data recorder of any truck involved should be reviewed.
- The family of any person who died should seek an independent review by a team experienced in accident reconstruction.
Truck accidents can have devastating consequences for all parties involved. Many victims are so severely injured that they are not able to return to work. Of course, far too many victims do not survive their injuries. One of the few things that remain consistent after any truck accidents is that truck companies will often do everything in their power to deny responsibility. The family of any person killed in a truck accident is able to seek some measure of accountability through a civil claim.
