San Bernardino County officials are saying the incident took place around 6:30 PM on July 1. A 65-year-old man was riding a Suzuki motorcycle when he was involved in a collision with a tractor-trailer combination vehicle.
The force of the impact ejected the motorcyclist onto the roadway, leaving him with critical injuries. Paramedics responded to the scene of the crash to help the victim.
He was transported to a local hospital to receive care. But he was beyond medical assistance and ultimately pronounced dead at the hospital.
Liability for Barstow Semi-Truck Accidents
Every person operating a motor vehicle in California must use reasonable caution to avoid collisions. Truck drivers are required to hold a commercial license and need to be especially careful, given the inherent dangers of operating a large vehicle. Many accidents involve truck drivers that make unsafe lane changes. According to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.” There are many ways that a truck driver may have acted negligently prior to a crash.
- A truck driver may have been traveling at a speed that would be unsafe during the prevailing conditions of the roadway.
- A truck driver may fail to check their blind spots before changing lanes on an interstate.
- A truck driver may not have slowed down during heavy traffic.
- A truck driver may have disobeyed hours-of-service regulations.
When truck drivers make unsafe lane changes and cause other vehicles to hit them, this could be used as evidence of negligence. Liability for any truck accident could extend to several different parties. For example, if a truck driver was working as an employee at the time of a crash, their employer could potentially be liable. However, truck companies will typically hire their drivers as independent contractors to limit their legal exposure in the event of a crash. It is important that the relationship between a truck driver and their carrier is explored when evaluating all potential liability angles.
Steps to Take After Barstow Truck Accidents
Accidents with commercial vehicles can be incredibly dangerous. According to the IIHS, “Most deaths in large truck crashes are passenger vehicle occupants. The main problem is the vulnerability of people traveling in smaller vehicles. Large trucks include anything with a gross vehicle weight rating over 10,000 pounds, but those on the heavier end of the spectrum can weigh 20 to 30 times as much as passenger cars.” Victims of semi-truck accidents should take proactive steps to protect their rights.
- Evidence Preservation: All of the physical evidence associated with the crash should be collected and preserved.
- Police Report: The police report created after the collision should be reviewed for potential mistakes.
- Medical Treatment: Victims should seek a thorough medical evaluation. Many of the injuries associated with these crashes will not be immediately obvious.
- Independent Review: Accident victims or their surviving family members should request an independent review by a team experienced in accident reconstruction.
Truck crashes can be highly complex events. The factors that may contribute to any specific collision could take place several hours or days beforehand. It is important that all contributing factors are probed. Victims of truck accidents are protected by a number of laws. They are able to seek some measure of accountability through a civil claim. This right extends to the survivors and family members of any person who dies. They can pursue some measure of accountability and justice through a wrongful death claim.
