Liability for Eureka Car Accidents
Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. It is therefore imperative that drivers follow all traffic regulations to avoid colliding with them. Pursuant to California Vehicle Code 21954, the driver of any vehicle must use due care to avoid colliding with any pedestrian on a roadway. Drivers should take several measures to avoid hitting pedestrians on the roadway.
- Blind Spots: Drivers should check their blind spots before proceeding through an intersection.
- Speed: Drivers should slow down during heavy traffic or inclement weather to avoid colliding with a pedestrian.
- Alert: Drivers must remain alert and continuously scan the road to avoid any hazards on the roadway.
If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this could form the basis of a negligence claim. Even if a pedestrian is in the middle of the roadway, this does not relieve a driver of their duty to use caution to avoid a collision. When a truck is involved in a collision, several entities could be liable for the crash beyond the driver. This will include the owner of the truck and the potential business that was using it.
Common Injuries Associated With Car Accidents
Many pedestrians are killed or seriously injured in motor vehicle accidents every year in the United States. According to the Governors Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” Victims are routinely left with very severe injuries.
- Broken Bones: Pedestrians may suffer broken bones and complex fractures from being hit by a vehicle.
- Head Injuries: The force of being hit by a vehicle can cause a pedestrian to hit their head on the ground. Car accidents remain a major cause of traumatic brain injuries.
- Organ Damage: Many of the injuries associated with the collision will not be outwardly obvious. In particular, victims may sustain major trauma to their internal organs.
Even if a person’s physical injuries completely heal, many survivors are left with long-term psychological trauma. This can manifest through anxiety, depression, or post-traumatic stress disorder. Recurring nightmares and panic attacks may occur. Any person injured due to the negligence of a truck driver may be able to seek some measure of accountability for a personal injury claim. Damages and a personal injury claim can help cover lost wages, medical bills, and pain and suffering.
