Liability for Simi Valley Pedestrian Accidents
Drivers have a duty of care to operate their vehicles with the caution and prudence necessary to avoid collisions. They must be particularly cautious when pedestrians are nearby. According to California Vehicle Code 21954, pedestrians must yield the right-of-way to vehicles that are close enough to constitute an immediate hazard. But this does not relieve a driver from their duty to exercise due care to safeguard the wellbeing of pedestrians. There are many errors that drivers could make that may contribute to a pedestrian collision.
- Many pedestrian collisions involve drivers who are distracted.
- Pedestrian crashes tend to take place in the early morning and late evening when visibility is reduced.
- Drivers are more likely to hit pedestrians at intersections, especially as they are trying to turn.
- A large portion of fatal pedestrian accidents involve intoxicated drivers.
If a driver fails to slow down to avoid colliding with a pedestrian, this could serve as evidence of negligence. Even if a pedestrian is standing still in the middle of a roadway, drivers must still use caution to avoid hitting them. Depending on the facts of any case, liability for a pedestrian crash could extend beyond one driver. For example, the company that owned a pickup truck could be liable for a crash if the vehicle was being used for a commercial purpose.
Steps to Take After Simi Valley Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured every year in preventable accidents. According to the Governors Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” It is important that certain actions are taken after any pedestrian accident.
- All of the medical records related to the accident should be collected.
- The police report created after the accident should be reviewed.
- Any person who may have witnessed the crash should be interviewed.
- The family of any person who died should seek an independent review by a team experienced in accident reconstruction and negligence claims.
Pedestrian accidents are often highly complex. The factors that contribute to any crash may take place long before the actual event. Part of the problem is that cities across California have continued to grow as pedestrian infrastructure has lagged behind. Victims of pedestrian accidents are protected by a number of laws. They are able to seek some measure of accountability through a civil action. This right extends to the family members of any person killed in a collision.
